My DD just had her Evaluation for Spec.Ed Tuesday.I'm waiting to hear the results.Does everyone need an Advocate?What does she do?Should I wait after I get her test scores or look for one now? I clicked on the links d posted and the closest one in SC is in Columbia.That's 100 miles away. Sorry for all the questions.I really don't understand alot of this.Thanks,Brenda

Hey Brenda. Have your school administrators been helpful so far? An advocate is someone who is familiar with the laws and helps you secure sp ed classification and services with your school. Also, without test scores and evaluation report, not sure if there is something to do yet.

My 14 year old is considered other health impaired by his doctors and although his school recognizes that, they will not place him under IDEA (special ed). His health has not been great for several years, but in January, it took a nose dive. He has intermittent homebound services (not under IDEA or 504, but under general ed) and is pretty much on fulltime homebound. He got very far behind quickly this school year because the school would not follow the 504 plan in place. I had trouble from day one. I had to fight just to get an extra set of books for home even though his doctor had filled out the necessary forms. I even offered to pay for the books. It’s just been one battle after another. He had to drop the Spanish class because he got so far behind (I have a stack of emails requesting his work in this class, but she wouldn’t send it). He also had to drop 2 electives.
I’m not going to further bog you down with the lack of services my son’s school has provided. Could you perhaps point me into the right direction? I’m not sure how to find out if other parents are having the same problem with our school district as we are. We are in the Clear Creek ISD in League City, Texas.
Our son has Spondylitis and has chronic pain. He also has Central Sleep Apnea, but cannot take meds for this because his heart rate is high and he suffers from orthostatic intolerance. He does take meds for acid reflux, but feels nauseated much of the time. He also has OCD and full blown Tourette’s, which his psychiatrist has stated on his OHI is severe.
What ever you can help me with is appreciated.

Sleigh, welcome to the board! Sounds like you've been fighting this battle for a long time. After any evaluation that the school did, have you ever requested an Independent Educational Evaluation (IEE) because you disagreed with the school's testing results? You can request this IEE at the school's expense and if they refuse, they must file for due process to prove that their evaluation is sufficient (which we all know it is not). In addition, there are many ways to prove that your son's health conditions affect his ability to learn, however, until you read up on the sped laws (wrightslaw.com), and begin documenting their violations, noting will ever change.
Retaining an advocate is also a good idea. If you go to copaa.org and wrightslaw.com they both have lists of advocates/sped attorneys. You can search by state.

We attended my grandson’s Jimmy October 29, 2009 IEP meeting and three year revaluation. Jimmy has not made appropriate effective progress. He is currently in a third grade L.D classroom taught by one teacher and one aid. There are 12 students. At the meeting Mrs. His teacher stated she could not teach him. She also said that my grandson second grade teacher and his summer school teacher had lied that Jimmy’s had made appropriate effective progress. His third grade teacher also stated at the 2009 IEP was the first time she had seen Jimmy’s 2008 IEP and independent neuropsychological evaluation. It was also stated during the meeting that Jimmy’s test scores shows regression. The testing is an objective measurement of Jimmy’s progress. We had been told during the last 3 years he’d been making progress. Now we find out this has been subjective evaluations not objective testing. Jimmy has not received adequate services to receive a FreeAppropriate Public Education (FAPE). In Jimmy’s 2008 independent neuropsychological evaluation conducted by Dr. David Dinklage he recommended “Jimmy needs one on one reading instruction every school day”. We requested in Jimmy’s 2008 IEP that he receive one on one OG reading school day. This was rejected by the other team members. They felt that he could make appropriate effective progress within the language based classroom. After Jimmy’s three year revaluation he is in regression. Jimmy made progress with touch math in the second grade, but is not received it currently. We reject this IEP in total based on Mrs. Mello’s inability to teach Jimmy, Jimmy’s regression in his testing, his accommodations not being placed in his L.D. Language based classroom. I just got back from the emergency IEP meeting after the rejection. The School will give 1 hour a day 5 days a week reading with something called WKRP, not the LMB we got my grandson evaluated for. The reading teacher has to be trained in this program and is not certified. I told them I wanted him objectively tested in two months to see if the program is working. We have not signed off on this yet Anyone with some ideas would be helpful Thanks JIM
