After a discussion with the principal of Josh's school talking about my wanting him on an IEP, he wanted me to request the IEP in writing which I just did (sent him an e-mail that said 'pursuant to our conversations I am formally requesting the IEP process begin for Josh'. Please let me know asap if you need anything further with regard to this request.)
Do I need to do anything else? What timeline do they have to respond? Do they begin the testing on him (knowing that the reason he would qualify is because of an emotional disturbance.)
I've been to the website posted on this board (MA Dept of Ed) and that's a help but I want to make sure I'm doing everything I need to do to get this party started.

You now have to sign a consent form for the testing. Then depending on the state you are in, they have a certain number of days to complete the testing and set up an IEP meeting to discuss the results, and if he qualifies for an IEP. What do you mean the reason he will qualify is because of an emotional disturbance? Putting the reason for an IEP under ED is very serious. Normally, you would not label a child ED at too young an age. How old is Josh? If he has ADHD, then he could qualify for an IEP under OHI (Other Health Impaired) or a 504 plan not Emotionally Disturbed.

No, I'm not in MA, I'm in California. I was out on the MA website that someone mentioned in a previous post about getting ideas for the IEP.
Josh is 6 and was recently diagnosed with bipolar, a mood disorder, anxiety disorder, and ADHD combined type.
I figured I need to sign a consent versus just sending an email requesting the plan, but I want to make sure I don't leave them wiggle room to say, like 40 days from now, "Oh well you never signed the forms so we haven't done anything....."

Yup, California has a timeline from the time you sign the consent form. I think it is 45 days, but I am not sure.

Thanks Mayleng. I was trying to do some research on the CA Dept of Ed and didn't find a whole lot. I need to do some more research so I am forearmed and forewarned.
I'm off work next week (being unemployed and all) so I'll have plenty of time then to do some solid research.

Go to the shcool and aslk for your rights as a parent of a student. They will provide you with the information, or they should!!! The 1st meeting we had to discuss setting up an iep they had to give the rights to us and we had to sign that we received a copy. It is just like when they are in trouble they give you papers that tell you your rights as a parent. Rights to appeal decisions and all that stuff will be in there. chaknine

When you have time next week. Go to: www.schwablearning.org/message_boards/index.asp?and post your questions there. There are alot of moms from CA with alot of experience there. They will be able to walk you through the IEP process. If you do a search on the message board, for "timeline" or "45 days" you will get some old posts that will have info on the timelines of the various states.
