Hello all- I live in PA and we have a intermediate unit that runs a lot of our special education classes within different school districts. These classes are paid for by the school district. There has been a movement that the districts are now taking back their sped ed classes and making them district run instead. If a child is currently placed outside his district, in an IU run class within another district, can that child remain in said district even if his class will become a district run class and not an IU run class? Can this child's home district pay the other district to educate him? His current placement class will remain the same, with the same teachers, with the same curriculum, but will lose the IU run status and become a district run classroom. He is currently doing very well in his placement. What are some of the laws regarding this type of change? Thanks in advance. ?

Tingngabe, I'm glad to hear that your son is doing well in his current placement. Unfortunately, because your questions are very specific to Pennsylvania, I think it would be best to contact parent support groups and/or legal aide reps in PA. I don't know exactly what part of PA that you live in, but you might ask one of the following to give you more advice: EDUCATION LAW CENTER(Non-profit legal advocacy and educational organization dedicated to ensuring that all of Pennsylvania’s children have access to a quality public education.) Hi Tingngabe, In regard to question of: "Can this child's home district pay the other district to educate him?" This would likely come under the same regulation, that makes it possible to get funding for placement in a private school.
Which is basically, that if a district is unable to provide adequate support and services to an LD student. But this adequate support and services are available in another school, which might be a private school. Which might be in another district. Then the district will assess this, from a financial position? Will it be cheaper for the district, to outsource this support and services, to a private school or another district? Than to pay to provide this themselves? Which they would be required to provide, under FAPE.
So that question is, 'Would this child's home district, find it cheaper to pay this other district to educate him?'
