Hi all - My high school daughter got in trouble last week in her resource class for not following instructions and being disrespectful to the RSP teacher. We have had multiple issues with this teacher but in this instance I would say my DDs behavior was uncalled for. The school feels she does not understand the severity of her behavior as well as show any remorse. I have to agree with that statement but also feel this ties in to her LD. I have requested a new case manager and RSP teacher due to the last 3 years of issues and the escalation in this relationship. In the interim while the school is figuring out case loads and if they can make this switch, they are not allowing my daughter to participate in her daily RSP period. She is being required to sit in the office and do her work. Is this a denial of services? The principal told me he asked her if she needed help with whatever she was working on and I kindly reminded him he was not a special ed credentialed teacher. When asked how long my DD would be sitting in the office during RSP they were unsure. I am sort of feeling this may not be ok???

Without seeing your daughter's IEP, it's difficult to know what services she's supposed to be getting during her RSP time. I know your daughter is a Junior... by the time my son was a H.S. Junior, he really just sat in a "supervised study hall" because it was a smaller, quieter setting to do his work. My son had accommodations for things like extended time on tests, but he wasn't getting any direct remediation or other direct IEP services.
Is the RSP teacher also your daughter's case manager, or are they two separate people? Is it a requirement that students usually have the same RSP teacher all four years? Is the school large enough so that there is "more than one" RSP classes being conducted at the same time, such that your daughter doesn't have to modify her schedule of other courses to get into a different RSP session? If the only way to get her into another RSP session is by switching RSP times, is there a fairly "easy" course she can swap (ie, maybe flip-flop with the period that she takes physical education?)

I would think you will probably want and should request an IEP meeting. That way you can discuss how she is going to continue to get the help she needs. Just because you requested to have a change in teacher/case manager does not mean that she should not remain in class or be given the help needed until this is resolved. Also I’m wondering if what they are doing would be considered a change in placement? Are they considering it an in school detention?

Denying service is not allowed. They can find another way for her to make up what she did.
