First I would like to state how grateful I am to have found this gem of a forum. I have spent hours and days reading through these amazing threads. I wish I would have known about this site years ago.
That being said I do have a technical question regarding the MET and eligibility. To summarize:
My son (currently a sophomore in HS) had an IEP in place from 2009-March 2014 when the district found him ineligible and exited him. I did not agree and filed a due process complaint. We settled through resolution and he currently has an IEP and supports. However the district did not revisit the MET that found him ineligible. My question is this. Is the district correct with this stance; that the MET does not need to recommend eligibility?
This is our correspondence.
District:
In regard to the question of changing the MET/REED date the MET of 3/14 recommended ineligibility for SLD and OHI. However the IEP Team on 9/14 determined xxx was eligible as OHI. He has a current IEP that provides programs and services as an eligible student, therefore no new REED or MET was required.
ME:
I appreciate the e-mail, however I do still have concerns regarding the MET/Reevaluation date indicated on the IEP. The current IEP does state eligibility for OHI, however there is no corresponding documentation to support the eligibility change. The MET is the document that supports the need for individualized special education services and specifically the disability. The last MET in this case finds xxx ineligible for special education services. In my experience it is not appropriate to change eligibility without a MET/Reevaluation. It seems odd that an annual IEP can support such claim…….

At this time, the Multidisciplinary Evaluation Team summary provides the "recommendation" of eligibility. You will see on page 3 of the MET under section IV. that it states "Eligibility Recommendation". The MET team recommendations eligibility to the IEP team who then, on page 1 of the IEP under "Eligibility" indicates "the student is/is not eligible for special education programs/services per the special education rule number(s) below." For this reason, we do not have to indicate a new MET/REED date since it is the IEP team on 9/14 who determined eligibility under OHI for xxxxx.
